Registration of the First Supplemental Deed In Relation to the Kenanga KLCI Daily 2X Leveraged ETF (“Fund”)



Dear Valued Investor,


The Manager of the Fund, Kenanga Investors Berhad (“KIB”) wishes to announce that the First Supplemental Deed dated 13 July 2023 (“First Supplemental Deed”) has been entered into between KIB and RHB Trustees Berhad (“Trustee”) as the trustee of the Fund, to amend the provisions of the deed governing the Fund dated 4 September 2019 (“Principal Deed”) in line with the revised Guidelines on Exchange-traded Funds issued by Securities Commission Malaysia (“SC”) and the relevant laws. 


The First Supplemental Deed has been registered with the SC and the key amendments to the Principal Deed are summarised below: 

  1. Amendments to the provisions relating to the suspension of dealing in units of the Fund; 
  2. Amendments to the provision relating to the valuation fees of the Fund;
  3. Amendments to the provisions relating to the duties and/or covenants of the Manager and the Trustee pursuant to the Main Market Listing Requirements of Bursa Malaysia Securities Berhad, Capital Markets and Services Act 2007 and the Guidelines on Exchange-traded Funds or the Guidelines on the Registration and Conduct of Capital Market Services Providers, as the case may be;
  4. Insertion of provision relating to termination of the Fund without prior approval of Unit Holders under circumstances specified in the First Supplemental Deed; and
  5. Amendments to provisions relating to meetings of Unit Holders including the quorum required for a meeting of the Unit Holders, the timeline to adjourn the Unit Holders’ meeting, the allowance of electronic medium as communication of proxy appointment to the Manager, and the allowance of conducting meetings of Unit Holders virtually.

The First Supplemental Deed will be available for inspection at the business office of the Manager at Level 14, Kenanga Tower, 237, Jalan Tun Razak, 50400 Kuala Lumpur during office hours on any business day of Kuala Lumpur. 


The Manager will issue a supplemental master prospectus for the Fund in due course to reflect the amendments stated above, where applicable, to comply with the applicable regulations, guidelines and laws.
